John F. Ward

Even though I have been involved in several of the largest patent cases ever tried, I approach every matter with the strategic perspective of helping my clients avoid litigation whenever possible.
About
John Ward has more than three decades of experience litigating intellectual property cases, including complex, high-technology patent cases, at both the trial and appellate levels. He has overseen intellectual property litigation in numerous foreign jurisdictions. John has also represented clients in dozens of patent infringement suits brought by non-practicing entities (NPEs).
In addition, John has litigated trademark, trade secret and copyright cases in state and federal courts. He also helps clients address the unfair competition and antitrust issues so frequently intertwined with intellectual property disputes. Of particular note, John is valued by his clients for helping them understand the complex technological factors involved in the protection of their intellectual property rights.
Furthermore, John advises clients on the procurement of intellectual property rights, portfolio development and licensing. He has authored hundreds of opinions relating to patent validity, infringement and enforceability for industrial companies, national retailers, airlines, banking and financial services companies, telecommunications carriers and equipment manufacturers, and professional sports leagues, among others.
As a registered patent attorney, John has extensive experience in proceedings before the Patent and Trademark Office, including successfully representing both petitioners and patentees in inter partes review (IPR) and covered business method (CBM) proceedings before the Patent Trial and Appeal Board (PTAB). His experience includes preparing and prosecuting patents in many technical disciplines, including software, computers, electronics, telecommunications, biotechnology, pharmaceuticals and the chemical arts.
John’s clients range in size from the largest multinational corporations to individual artists and inventors. His recent litigation matters have involved computer hardware and software, Internet technologies, telecommunications systems and cellular networks, e-commerce, pharmaceuticals, consumer products and luxury goods.
A charismatic speaker and educator, John has lectured on intellectual property law issues for the American Law Institute and American Bar Association.

Experience
Represented domestic and foreign airlines in a patent infringement action brought in the Eastern District of Texas. A summary judgment of non-infringement was affirmed by the Court of Appeals for the Federal Circuit.
Representing the inventor of a patent directed to a fuel pump recirculation system in a patent infringement suit in the Eastern District of Pennsylvania and concurrent PTAB proceeding. Successfully defended the patent in an IPR filed by a major automobile manufacturer.
Represented a prominent health and beauty aids manufacturer in a patent infringement action in the District of Delaware. A jury verdict of invalidity was affirmed by the Federal Circuit.
Representing an international confectioner in a trademark infringement and breach of contract action filed against a former distributor in the Eastern District of New York.
Represented the leading manufacturer of industrial diamonds in patent infringement actions brought against competitors in the United States and foreign jurisdictions.
Representing the inventor of a patent portfolio directed to insurance claim processing systems in multiple patent infringement suits and concurrent PTAB proceedings.
Represented the leading intimate apparel retailer in a patent infringement suit relating to electronic data processing in the Eastern District of Texas. A summary judgment of non-infringement was affirmed by the Federal Circuit.
Represented a retailer of home fragrance products in a patent infringement lawsuit in the Northern District of Illinois. The Federal Circuit found both non-infringement and invalidity.
Represented multiple clients in dozens of patent infringement lawsuits brought by NPEs in technologies including vehicle monitoring and notification systems; check-by-phone payment systems; electronic proposal preparation systems and computer-assisted sales methods; e-commerce express checkout functionality; auto-complete online search functionality; e-commerce notification technology; e-commerce shopping cart technology; store locator technology; short message service technology; WiFi technology; transferring dynamic web page generation requests from a web server to an application server; Internet live chat technology; JPEG image encoding; computerized sales force automation; SSL authentication and encryption; e-commerce substitute product functionality; fraud prevention technology; and online mouse-over preview technology.
